ECC was retained by a major utility as an Expert Witness in multiple high-value disputes concerning the pricing terms in its long-term gas supply agreements. In supporting the client ECC successfully:

  • Designed and framed a commercial strategy for the renegotiation of key terms in the agreement. 

  • Worked closely with the client and its legal representatives to develop an appropriate claim structure and methodology that met the requirements of the price review clauses and addressed the key changes in market conditions.

  • Assessed the market value of gas in the relevant European sales markets, using a variety of economic and financial techniques. This required a thorough analysis of gas transportation, storage and marketing costs in these markets.

  • Conducted in-depth gas market assessments and surveys to establish the causes and impacts of changes to the relevant markets during the review period.

  • Evaluated the client’s ability to economically market gas by conducting detailed analysis of its own extensive transaction data.

Prepared a number of Expert reports covering inter alia the issues above, and detailed reply and rebuttal to reports provided by expert witnesses for the counter party. ECC also provided expert testimony during the arbitration hearing.
